1. Who we are
This website, artbyvaynberg.com, and the online painting courses sold through it are operated by artbyvaynberg ("we", "us", "Art by Vaynberg").
You can reach us at team@artbyvaynberg.com. We aim to answer within two working days.
By using this website or buying anything from it, you confirm you have read and accepted these Terms.
2. What we sell
We sell two kinds of things.
Digital products: online painting courses delivered as pre-recorded video lessons and downloadable materials, accessed through a member account on this website.
Physical products: original paintings and prints, where offered.
Course descriptions state the number of lessons, the length of access, and whether written or voice feedback from the artist is included. Nothing else is implied.
3. Buying a course
You buy a course by choosing a plan and completing checkout. Your purchase is confirmed by email. If you do not receive a confirmation email within one hour, write to team@artbyvaynberg.com and we will resend it.
4. Access
Access starts as soon as your payment is confirmed and lasts for the period stated on the plan you bought, counted from the date of purchase.
You need a member account on artbyvaynberg.com to view the lessons. Access is personal to you. Do not share your login, and do not give anyone else access to the lessons.
When the access period ends, your access closes. We may offer an extension at a reduced price, at our discretion.
We aim to keep the course available and working throughout your access period. If a technical problem on our side prevents access for more than 72 hours, we will extend your access by the time lost.
5. Feedback tiers
Where a plan includes feedback, you may submit your work for review as described in that plan. Feedback is given by the artist in written or voice form, normally within seven days of submission, and covers the painting you are working on within the course. Personal feedback is an optional add-on (£9). It covers feedback by text or voice message on your painting.
Feedback is teaching, not a guarantee of any particular result.
Places on feedback plans may be limited. When a limit is reached, the plan closes until new places open.
6. Right to cancel and refunds
This section applies to consumers in the UK and the EU.
Digital courses. You normally have 14 days to change your mind about a digital purchase. Because course access is granted immediately, you agree at checkout that performance begins at once and that you lose your right to cancel once you have started accessing the course content. If you have not opened any lesson, you may cancel within 14 days of purchase and receive a full refund. Write to team@artbyvaynberg.com from the email address you used to buy.
Beyond that, we will refund a course if it is faulty, not as described, or if a technical fault on our side stops you using it and we cannot fix it.
Physical products. You may cancel within 14 days of delivery and return the item unused and in its original condition. Return postage is yours unless the item arrived damaged or was not as described. Refunds are issued within 14 days of us receiving the return.
Refunds go back to the original payment method.
7. Your content
If you send us images of your paintings, whether for feedback or by tagging us, you keep all rights to your work.
By submitting work for feedback you allow us to view it for the purpose of teaching you.
We will not publish your work, your name, or your feedback publicly without asking you first and getting your agreement in writing, including by email.
8. Our content
All course videos, materials, written text, photographs, paintings, logos, and the design of this website belong to us or to our licensors.
You may use course materials for your own personal learning. You may paint from the course as much as you like, and paintings you make from it are yours.
You may not record, download where downloading is not offered, copy, resell, republish, share, or teach from our course materials, and you may not use them to train any machine learning system.
9. Behaviour
We may suspend or close your access without refund if you share your login, distribute our materials, or abuse the artist or other members. This is the only circumstance in which we close paid access early.
10. What we are not responsible for
We provide the courses with reasonable care and skill. Painting involves materials, tools, and solvents. Follow the safety instructions on the products you buy and work in a ventilated space. We are not responsible for injury, damage to property, or damage to your materials arising from how you choose to work.
We are not responsible for losses that were not foreseeable, for loss of profit, or for any business loss, since our courses are sold for personal use.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
11. Marketing emails
If you tick the newsletter box or ask for a free download, we will send you occasional emails about courses, new work, and offers. Every email has an unsubscribe link, and you can also write to team@artbyvaynberg.com at any time.
Buying a course does not by itself sign you up to marketing. Emails about your purchase and your access are service emails and are sent regardless.
12. Changes to these Terms
We may update these Terms. The version that applies to your purchase is the version published on the date you bought. Material changes will be noted on this page with a new effective date.
13. Law and disputes
These Terms are governed by the law of FILL IN England and Wales, OR your jurisdiction, and disputes fall to the courts of that jurisdiction. If you are a consumer resident elsewhere in the UK or EU, you keep the protections of your local law.
If something goes wrong, write to team@artbyvaynberg.com first. Most problems are solved in one email.

What we collect
Given by you: name, email address, billing address, phone number if you provide one, and the contents of messages you send us. Card details are handled by our payment providers and never reach us.
Collected automatically: IP address, browser and device type, pages visited, time spent, referring site, and login records.
From your use of the course: which lessons you have opened and how far through the course you are.
Work you submit for feedback: the images and any notes you send.
Why we use it
To give you access to what you bought and to keep that access working.
To answer your messages and handle refunds and disputes.
To send service emails about your purchase, your access, and your access ending.
To send marketing emails, only if you asked for them.
To understand how the site is used and improve it.
To meet our legal and tax obligations.
Legal basis
Performance of a contract, for giving you the course you bought.
Consent, for marketing emails and non-essential cookies. You can withdraw it at any time.
Legitimate interests, for site security, fraud prevention, and basic analytics.
Legal obligation, for keeping transaction records.
Who we share it with
Wix, which hosts the site, the member area, the courses, and the store.
Our payment providers, which process your payment.
Our email provider, which sends our emails.
Meta and other advertising platforms, where our advertising tools tell them that a purchase or a page visit happened. This is how ad performance is measured. You can limit this in your own Facebook and Instagram ad settings, and through the cookie banner on this site.
We do not sell your personal data. Ever.
Some of these providers are outside the UK and EU. Where that happens, transfers are covered by the safeguards those providers put in place, such as standard contractual clauses.
How long we keep it
Account and purchase records: seven years, for tax and accounting.
Marketing list: until you unsubscribe, then we keep a record that you unsubscribed so we do not email you again.
Work submitted for feedback: 12 months, then deleted, unless you asked us to keep it.
Analytics data: 26 months.
Your rights
You can ask us to show you the data we hold, correct it, delete it, restrict how we use it, send it to you in a portable format, or stop using it for marketing.
Write to team@artbyvaynberg.com. We answer within one month.
If you are not satisfied, you can complain to the UK Information Commissioner's Office at ico.org.uk, or to your local data protection authority in the EU.
Cookies
We use cookies that are needed to run the site and keep you logged in, and, with your consent, cookies that measure traffic and advertising. You choose through the banner on your first visit and can change your choice at any time.
Children
Our courses are sold to adults. We do not knowingly collect data from anyone under 16. If you believe a child has given us data, write to team@artbyvaynberg.com and we will delete it.
Changes
We may update this policy. Material changes are noted here with a new effective date.
