Lavender Tide — Terms of Purchase

These Terms of Purchase (“Terms”) apply to all purchases of the Lavender Tide online painting course (“Course”) through this website.
The Course is provided by Vlada Vaynberg [insert full legal/business name], trading as [insert trading name, if applicable], with a business/contact address at [insert address] (“I”, “me”, “my”).
By purchasing the Course, you agree to these Terms.
These Terms apply to customers worldwide. If the law of the country where you live gives you mandatory consumer rights that cannot legally be excluded or limited by contract, those rights continue to apply.
1. What You Are Purchasing
Lavender Tide is a self-paced online educational course teaching oil painting techniques through pre-recorded video lessons and supporting digital materials.
The following options may be available:
Self-Paced — £29
Includes:

access to the Course video lessons;
-
materials list;
-
drawing template;
-
step-by-step checklist; and
-
access for 90 days from the date access is provided.
With Feedback — £39
Includes everything in the Self-Paced option plus personal feedback relating to your Lavender Tide painting during your active Course access period.
Feedback may be provided by text, voice message or another method specified within the Course.
I aim to respond within 24 hours. This is a target rather than a guaranteed response time, and occasional delays may occur because of illness, holidays, technical issues, unusually high demand or circumstances outside my reasonable control.
Feedback places may be limited.
2. Price and Payment
The price shown at checkout is the price payable for your purchase.
Payment is a one-time payment unless the checkout expressly states otherwise.
There is no automatic subscription or recurring charge unless you separately and expressly agree to one.
Payments may be processed by Wix and/or third-party payment providers.
Prices will be displayed in the currency available at checkout. Your bank or payment provider may apply currency-conversion or international transaction charges, which are outside my control.
Taxes will be handled as required by applicable law and the relevant payment or ecommerce system.
3. Course Access
Course access normally begins immediately following successful payment.
Your access lasts for 90 days, unless a different period is expressly shown at the time of purchase.
You are responsible for accessing and completing the Course during your access period.
Not completing or watching all of the Course during your access period does not, by itself, create a right to a refund or extension.
I may separately offer you an extension or renewal. Any renewal price, discount and access period will be stated in that particular offer.
4. Immediate Digital Access and Cancellation / Withdrawal Rights
The Course contains digital content supplied online.
Depending on where you live, consumer law may provide you with a cancellation, cooling-off or withdrawal period for purchases made online.
UK and European Customers
Consumers in the United Kingdom and European Union will generally have a statutory 14-day cancellation or withdrawal period for qualifying distance contracts.
However, special rules apply where paid digital content is supplied immediately.
Before immediate access is provided, where required by applicable law, you will be asked to:

expressly request and consent to the supply of the digital content beginning immediately, before the end of the 14-day cancellation or withdrawal period; and
-
expressly acknowledge that once supply of the digital content begins, you will lose your statutory right to cancel or withdraw from the digital-content purchase.
Once you have given that consent and acknowledgement and supply of the Course begins, your 14-day cancellation or withdrawal right in relation to that digital content will end, to the extent permitted by applicable law.
For UK digital content, this express consent and acknowledgement are specifically required for the cancellation right to be lost.
EU rules use substantially the same approach: paid digital content supplied without a physical medium can lose the withdrawal right after performance begins where the consumer has given prior express consent, acknowledged the loss of the right, and received the required confirmation.
Customers in Other Countries
If consumer law in your country gives you a mandatory cancellation, withdrawal or cooling-off right that cannot legally be waived, nothing in these Terms removes that right.
Where local law permits such rights to end following the immediate supply of digital content, your express request for immediate access and acknowledgement at checkout will apply to the fullest extent permitted by that law.
5. Refunds
Except where you have a statutory right to a refund, withdrawal, cancellation or other remedy under applicable law, payments for the Course are non-refundable after digital Course access has begun.
Changing your mind, deciding that you no longer wish to complete the Course, not having enough time to complete it, or failing to use your access does not by itself create a right to a refund once your applicable cancellation or withdrawal right has ended.
However, nothing in these Terms limits any refund or remedy that you are legally entitled to receive under mandatory consumer law.
6. Faulty or Non-Conforming Digital Content
I am responsible for supplying the Course substantially as described.
If you experience a genuine problem with the Course, including an access problem or digital content that is materially faulty or not supplied as described, please contact me at [support email].
I will take reasonable steps to investigate and resolve the problem.
Depending on the law applicable to you, you may have statutory rights to remedies such as having digital content brought into conformity, a price reduction, termination or refund.
For example, EU digital-content rules provide remedies where qualifying digital content is not supplied or does not conform with the contract.
Nothing in these Terms excludes or limits those mandatory rights.
7. Personal Licence
Your purchase gives you a personal, limited, non-exclusive, non-transferable and revocable licence to access the Course during your applicable access period for your own personal learning.
Purchasing the Course does not transfer ownership of the Course or its intellectual property to you.
Unless I give you prior written permission, you must not:

share your Course login or account with another person;
-
allow another person to access the Course through your account;
-
reproduce or redistribute Course videos;
-
record or screen-record Course videos for sharing or redistribution;
-
copy, reproduce or distribute Course guides or teaching materials;
-
upload Course materials to social media, websites, messaging groups, cloud folders, torrents or file-sharing services;
-
sell, sublicense, rent or commercially distribute Course content;
-
publish substantial portions of the Course;
-
translate and redistribute Course materials;
-
use Course materials to create a substantially copied course, workshop, tutorial, downloadable guide or competing educational product;
-
remove copyright or ownership notices from Course materials; or
-
make Course content available to anyone who has not purchased authorised access.
8. Account Sharing, Piracy and Unauthorised Distribution
Your Course access is for one purchaser only.
If I reasonably suspect that Course access is being shared, resold, copied, pirated or otherwise used in serious breach of these Terms, I may temporarily suspend the account while the matter is investigated.
If a material breach is confirmed, I may terminate access where lawful and proportionate.
I may also take reasonable legal or technical steps to protect my intellectual property.
Nothing in this section limits any statutory consumer rights that cannot legally be excluded.
9. Your Finished Artwork
Paintings you personally create while following the Course belong to you.
You may:

keep them;
-
display them;
-
gift them; or
-
sell your finished physical paintings.
Your ownership of your own finished artwork does not give you ownership of the Course itself or permission to reproduce or distribute my teaching materials, videos, templates, photographs, written guides or other Course content.
10. No Guarantee of Results
The Course is educational.
Your results will depend on factors including your experience, practice, materials, equipment, time spent painting and personal artistic choices.
Examples of my work or students’ work are provided for illustration and inspiration only.
I do not guarantee that your painting will look identical to any example shown.
I also do not guarantee any particular artistic, professional, social-media, business or financial result from taking the Course.
11. Feedback Tier
If you purchase the With Feedback option, feedback relates specifically to artwork and questions connected with the Lavender Tide Course.
The feedback option is intended to provide reasonable personal guidance and does not constitute unlimited one-to-one private tuition.
You may send reasonable progress updates, images and questions during your active access period.
To keep feedback manageable and fair for all students, I may ask you to combine multiple small questions into a single message or wait for a response before sending repeated follow-up messages.
Feedback is available only during your applicable Course access period unless otherwise stated.
Abusive, threatening, discriminatory, harassing or seriously inappropriate communication is not permitted.
12. Technical Requirements
You are responsible for having:

a suitable internet connection;
-
a compatible device;
-
an up-to-date web browser; and
-
any software reasonably required to access the Course.
I am not responsible for a failure to access the Course caused solely by your own device, internet connection, network restrictions or third-party software.
If an issue on my side materially prevents access, I will take reasonable steps to restore it.
Where appropriate, I may extend your access to compensate for a significant period during which the Course was genuinely unavailable because of a problem within my control.
13. Course Availability and Updates
I may reasonably update or improve the Course from time to time.
This may include:

correcting errors;
-
improving existing lessons;
-
updating recommendations;
-
replacing files;
-
improving video quality;
-
restructuring Course content; or
-
making reasonable technical changes.
Any changes made during your access period will not intentionally remove the essential Course content you purchased without an appropriate reason or remedy.
14. Intellectual Property
Unless expressly stated otherwise, all intellectual property rights in the Course and its original materials belong to me or are lawfully licensed to me.
This includes, where applicable:

Course videos;
-
written lessons;
-
templates;
-
PDFs;
-
downloadable materials;
-
photographs;
-
graphics;
-
demonstrations;
-
lesson structure;
-
branding; and
-
original educational materials.
All rights not expressly granted to you under these Terms are reserved.
15. Chargebacks and Payment Disputes
If you believe a payment has been made incorrectly or there is a problem with your purchase, please contact me first at [support email] so I have an opportunity to investigate the issue.
Nothing in these Terms prevents you from exercising legitimate rights through your bank, payment provider or applicable consumer law.
If you initiate a payment dispute or chargeback, I may provide the relevant bank or payment provider with information reasonably necessary to respond to the dispute.
This may include records showing:

the transaction;
-
the Course purchased;
-
delivery of Course access;
-
Course access records;
-
acceptance of these Terms;
-
your request for immediate digital access; and
-
your acknowledgement concerning applicable cancellation or withdrawal rights.
Personal information will only be shared for this purpose where reasonably necessary and permitted by applicable law.
16. Misuse of Refund or Chargeback Procedures
Submitting a refund request or chargeback does not itself constitute misuse.
However, deliberately making false statements about a transaction, falsely claiming that Course access was never supplied when records show otherwise, or otherwise fraudulently abusing a payment-dispute procedure may result in suspension of Course access and may be challenged with the relevant payment provider.
This provision does not restrict legitimate consumer complaints, refunds, statutory remedies or payment disputes.
17. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms excludes or limits your mandatory statutory consumer rights.
To the extent permitted by law, I am not responsible for:

losses that were not reasonably foreseeable when the contract was entered into;
-
losses caused exclusively by circumstances outside my reasonable control;
-
problems caused exclusively by your own internet connection, device or software; or
-
business losses arising from use of a Course purchased primarily for personal consumer purposes.
Nothing in these Terms excludes liability that cannot legally be excluded.
18. Events Outside My Reasonable Control
I will not be responsible for delay or failure caused by events outside my reasonable control, such as major platform outages, internet infrastructure failures, natural disasters or other comparable events.
If such an event materially affects Course access for an extended period, I will take reasonable steps to minimise the impact and provide an appropriate solution where required.
19. Privacy and Personal Data
Personal information collected in connection with your purchase and participation in the Course will be handled in accordance with my Privacy Policy and applicable data-protection law.
Third-party services such as Wix and payment providers may process your information under their own privacy policies.

I will aim to deal with legitimate complaints reasonably and promptly.
21. International Customers
The Course is available for online purchase by customers in multiple countries.
It is your responsibility to ensure that purchasing and accessing the Course is lawful in your location.
If local consumer law gives you mandatory protections that are more favourable than a provision in these Terms, the mandatory local protection will apply to the extent required by law.
A provision of these Terms becoming unenforceable in one jurisdiction does not automatically make the remaining provisions unenforceable.
22. Governing Law and Jurisdiction
These Terms and the contract between you and me are governed by the laws of England and Wales.
However, if you purchase as a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of habitual residence where those protections cannot legally be excluded by contract.
In particular, consumers in the European Union may retain mandatory protections provided by the law that would otherwise apply to their consumer contract.
Nothing in these Terms requires a consumer to give up any right to bring proceedings in a court or forum that applicable mandatory law entitles that consumer to use.
23. Changes to These Terms
The Terms applicable to your purchase are the version presented to you at the time you make the purchase.
I may update these Terms for future purchases.
A later version will not retrospectively remove mandatory rights or materially alter the contract relating to an earlier purchase where doing so would be unlawful.
24. Entire Agreement
These Terms, together with the Course description displayed at the time of purchase, applicable checkout information and the Privacy Policy, form the agreement relating to your Course purchase.
Nothing in this section excludes liability for fraudulent statements or affects rights that cannot legally be excluded.
25. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will apply only to the extent legally permitted.
The remaining provisions will continue to apply where legally possible.
